1. Terms and Conditions

Effective Date: November 4, 2025
Provider: BuildBetterFunnels (“Company,” “we,” “us,” or “our”), operating under the names BuildBetterFunnels, Buildbetterfunnels, or Build Better Funnels.

By purchasing or using our domain hosting services (“Services”), you (“User,” “you,” or “your”) agree to be bound by these Terms and Conditions, as well as our Terms of Service, which are incorporated by reference.

1.1. Agreement to Terms & Updates

1.2. Binding Agreement: By purchasing, using, or continuing to use our domain hosting Services, you acknowledge and accept these Terms.

1.3. Right to Modify: We reserve the right to update these Terms as needed to reflect operational, legal, or business changes. If changes materially affect your rights, we will provide at least 60 days’ notice before they take effect.

1.4. User Acknowledgment: It is your responsibility to review these Terms periodically. Continued use of the Services after an update constitutes acceptance of the revised Terms. If you do not agree, you must discontinue use immediately.

2. Domain Ownership & Control

2.1. Exclusive Ownership: All domains registered, purchased, transferred, or managed through BuildBetterFunnels remain the sole and exclusive property of BuildBetterFunnels unless explicitly agreed otherwise in a signed written contract that is active.

2.2. Automatic Ownership Transfer to Us: By purchasing or transferring a domain to our system or a third-party tool we use, you agree that BuildBetterFunnels retains full ownership rights, including but not limited to:
• Initiating or approving a transfer into our system.
• Domains purchased, registered, or managed through our infrastructure.

2.3. Administrative Rights: BuildBetterFunnels retains full control over all hosted domains, including:
• DNS management, modifications, and renewals.
• Authority to act as the registrant, administrative, and technical contact.

Users cannot request domain transfers or changes unless separately agreed upon in writing that is active.

3. Pricing & Fee Adjustments

3.1. Right to Modify Pricing: Domain hosting is provided at a fixed rate of €5 per month per domain, which will remain unchanged unless subject to an increase under Section 3.2.

3.2. Notice of Fee Changes: Hosting fees will only be increased under the following circumstances:
• Global industry-wide price increases imposed by registrars or infrastructure providers.
• Inflation-based adjustments (limited to official inflation rates).
• Market standards changes.
In such cases, BuildBetterFunnels will provide at least 60 days’ notice before any change takes effect.

3.3. Domain Sales & Pricing: 
• BuildBetterFunnels retains full discretion over domain pricing for domains under its management.
• Users may request a purchase quote, but we are under no obligation to sell a domain at any requested price.

3.4. Notice of Pricing Adjustments:
Users will be informed of any pricing adjustments via:
• Email notification.
• Account dashboard updates (If active user in our CRM).

If a User disagrees with the new pricing, they may terminate their hosting service within 30 days without penalty. 

4. Termination & Domain Retention

4.1. Post-Termination Rights: If your Services are terminated due to non-payment, breach, or cancellation:
• The domain remains the exclusive property of BuildBetterFunnels.

4.2. No Transfer Guarantee: We are not required to transfer or release a domain after termination. Any associated data may be deleted unless legally required to maintain by an active agreement.

4.3. No Refunds: Termination does not entitle the User to refunds, credits, or compensation for hosting or domain-related costs.

5. Legal Waivers & Dispute Resolution

5.1. Limitation of Legal Recourse: By accepting these Terms, you waive any right to:
• Dispute domain ownership, renewal fees, or retention.
• Seek legal action related to domain control.
• Challenge price adjustments made under Section 3.2.

5.2. Binding Arbitration: All disputes shall be resolved exclusively through binding arbitration in Denmark.
• Governing Law: This agreement is governed by Danish law.
• Arbitration Location: Copenhagen, Denmark, or another location within Denmark chosen by BuildBetterFunnels.
• Costs: Each party bears their own arbitration costs. BuildBetterFunnels is not responsible for the User’s legal fees.
• No Class Actions: Users waive the right to bring collective lawsuits.
• Final & Binding Decision: Arbitration decisions are non-appealable and enforceable under Danish law.

By using our Services, you expressly agree that all disputes will be handled in Denmark under Danish law, regardless of your location. If you do not agree, you must immediately discontinue use of the Services.

5.3. Limitation of Liability: BuildBetterFunnels is not liable for damages arising from:
• Service interruptions.
• Loss of domain ownership due to non-payment or termination.
• Third-party actions affecting a domain.

6. Domain Valuation & Purchase Requests

6.1. User-Initiated Valuation Requests: You may request a domain valuation for hosting credit or purchase consideration.

6.2. Discretionary Valuation: Domain valuation is entirely at our discretion.

6.3. No Sale Obligation: We are not obligated to sell any domain. If we choose to sell, pricing and terms will be determined solely by us.

7. General Provisions

7.1. Entire Agreement: These Terms replace all prior agreements (verbal or written). Amendments require written approval from BuildBetterFunnels.

7.2. Severability: If any provision is deemed unenforceable, the rest of the agreement remains valid.

7.3. Updates to Terms: We may change these terms at any time. It is your responsibility to stay informed. Continued use after updates means you accept the new terms.

8. Acknowledgment & Acceptance

By purchasing or using our Services, you confirm that you have read, understood, and agreed to these Terms. Violation of these Terms may result in immediate termination of Services.
