1. Terms and Conditions

Provider: BuildBetterFunnels (“Company,” “we,” “us,” or “our”), operating under the names BuildBetterFunnels, Buildbetterfunnels, or Build Better Funnels.

By purchasing or using our domain hosting services (“Services”), you (“User,” “you,” or “your”) agree to be bound by these Terms and Conditions, as well as our Terms of Service, which are incorporated by reference.

1.1. Agreement to Terms & Updates

1.2. Binding Agreement: When you purchase or use any Extra Service, including domain hosting, you automatically agree to these terms as part of the full Terms of Service.

1.3. Right to Modify: We reserve the right to update, change, or modify these terms at any time without prior notice. Changes take effect immediately upon posting. It is your responsibility to check these terms regularly.

1.4. User Acknowledgment: By continuing to use the Services after updates, you acknowledge and accept the new terms. If you disagree, you must immediately discontinue use of the Services.

2. Domain Ownership & Control

2.1. Exclusive Ownership: Any domain registered, purchased, transferred, or managed through BuildBetterFunnels—including via third-party registrars or hosting providers—is the sole and exclusive property of BuildBetterFunnels, unless explicitly agreed otherwise in a separate written contract signed by both parties.

2.2. Automatic Ownership Transfer to Us: You irrevocably agree that BuildBetterFunnels retains full ownership rights to any domain under the following circumstances:
• Verbal Agreement: You verbally confirm the transfer or purchase.
• Domain Transfer: You initiate or authorize the transfer of the domain into our system or third-party system we use.
• Company Purchase: We register, purchase, or manage the domain on your behalf.

2.3. Administrative Rights: We retain full control over the domain, including:
• DNS management, renewals, modifications, and transfers.
• The right to act as the registrant, administrative, and technical contact.

3. Pricing & Fee Adjustments

3.1. Right to Modify Pricing: We reserve the right to change hosting fees, renewal costs, or management fees at any time based on market factors, operational costs, or business strategy.

3.2. Notice of Fee Changes: Pricing changes will be communicated via:
• Your account dashboard.
• Email notification.
• Public notice on our website.

3.3. User Responsibility: You are responsible for reviewing pricing updates. Continued use of the Services after a fee change constitutes acceptance of the new pricing.

4. Termination & Domain Retention

4.1. Post-Termination Rights: If your Services are terminated—whether due to non-payment, breach, or cancellation—you forfeit all rights to the domain.

4.2. No Transfer Guarantee: We are not obligated to transfer the domain to another provider. All associated data may be permanently deleted unless legally required. We will be the owner of the domain.

4.3. No Refunds: Termination does not entitle you to any refunds, credits, or compensation for domain-related costs.

5. Legal Waivers & Dispute Resolution

5.1. No Legal Recourse: You waive all rights to pursue legal action against BuildBetterFunnels regarding:
• Domain ownership, renewal fees, or retention.
• Termination of Services or refusal to transfer a domain.
• Changes to pricing or terms.

5.2. Binding Arbitration: All disputes arising from these Terms or the use of our Services shall be resolved exclusively through binding arbitration in Denmark.
• Jurisdiction & Governing Law: This agreement is governed by Danish law, and any legal matters, claims, or disputes must be resolved under the jurisdiction of Danish courts or arbitration authorities.
• Location of Arbitration: The arbitration shall take place in Copenhagen, Denmark, or another location within Denmark chosen by BuildBetterFunnels.
• Costs & Fees: You agree to bear your own arbitration costs and understand that BuildBetterFunnels is not responsible for any legal fees you incur.
• No Class Actions: You waive any right to bring a class action or collective lawsuit against BuildBetterFunnels.
• Final & Binding Decision: The arbitration decision is final, non-appealable, and enforceable under Danish law.

By using our Services, you expressly agree that all disputes will be handled in Denmark under Danish law, regardless of your location. If you do not agree, you must immediately discontinue use of the Services.
5.3. Limitation of Liability: We are not liable for damages resulting from:
• Service interruptions.
• Loss of domain ownership due to non-payment or stopped work.
• Third-party actions affecting your domain.

6. Domain Valuation & Purchase Requests

6.1. User-Initiated Valuation Requests: You may request a domain valuation for hosting credit or purchase consideration.

6.2. Discretionary Valuation: Domain valuation is entirely at our discretion.

6.3. No Sale Obligation: We are not obligated to sell any domain. If we choose to sell, pricing and terms will be determined solely by us.

7. General Provisions

7.1. Entire Agreement: These terms replace all prior agreements, verbal or written. Amendments require written approval from BuildBetterFunnels.

7.2. Severability: If any clause is found unenforceable, the rest of the agreement remains valid.

7.3. Updates to Terms: We may change these terms at any time. It is your responsibility to stay informed. Continued use after updates means you accept the new terms.

8. Acknowledgment & Acceptance

By purchasing or using our Services, you confirm that you have read, understood, and agreed to these Terms. Failure to comply may result in immediate termination of Services.
